-Be aware of where you are after dark. This crime happened in a parking lot at night. What was Davis doing there? What was 'Redd' and Collins (other people implicated in the shooting) doing there? MacPhail was working as a nearby security guard for a Burger King nearby and intervened in a scuffle in the nearby lot, where Davis and others were. Any neighborhood that a Burger King needs to have a security guard is not one to be out at night, especially if you have a questionable reputation.
-Attorneys! Attorneys! Attorneys! From start to finish the defense attorneys dropped the ball. I'm assuming Davis was not a wealthy man as he depended on public defenders. Public attorneys are usually the bottom of the barrel attorneys that usually assume the party is guilty anyway. They said their original poor performance was due to lack of resources, i.e I don't care if a man's life is at stake, I'm not working overtime unless I'm getting paid. Their first appeal was that the demographics and location of the trial effected Davis' ability
to have a fair trial. The jury was made up of 7 Blacks and 5 whites. Of course, that was going to be turned down. It is not enough to say, he's innocent. You must prove it legally. You must know someone who has the legal sharpness to know how to prove it or work the system. Or you can always represent yourself. Once the appeals came around and even though 7 out of 9 witnesses recanted their statements years later, it had been too long, thus weakening the strength of the statements. The NAACP loves to say 'this justice system is unjust' but do they have a team of lawyers to really defend innocent people? What you think doesn't count. Its what you can prove.
-There are too many holes in the case. No one knows who did it. There had to be something tremendously crucial for 7 out of 9 people to recant their statements with a signature and not one judge overturn the case or at least ask for a new one. There had to be something major that the public does not know that for 20 years, the MacPhail family never considered that Davis was innocent and worked with the Davis family to have a retrial. The Pope, Desmond Tutu, and Presidents couldn't change the verdict either? Why hasn't Redd and Collins been convicted of anything? Redd was a known thug. Did he have anything on the police and the police covered him in order to shield the dept from public shame? Nonetheless, the police dept would've had to pay off every court channel this case was appealled through. That doesn't seem plausible. Why did none of this man's fellow police officers come to the execution? Was MacPhail doing something shady that time of night that the family thought sending the wrong man to jail was worth less than shaming the family name? I was watching CNN last night when they said the brother and son looked Davis straight in the eye while he was dying. I'm sorry. People can think they get away with stuff but guilt is a ruthless hounddog. Looking a man straight in the eye while he is dying is not the stance of someone who isn't 100% sure that they got the right guy. CNN which leans left and I wouldve thought would've used Davis as a ploy to end the Death Penalty moved on to the next topic after Davis died. Did they think Davis was guilty and thus televised the statements post execution out of respect due to the ratings it would bring in? and its audience was attracted to this story? Only God knows.
Praying for the Davis and MacPhail family. They've been at it for 20 grueling years. I cannot imagine how waking up today felt. Neither family will probably ever be totally over this experience.
